Bodenheimer Legal Theory

The first part now contains a discussion of the important current contributions to jurisprudence. The second part has been largely rewritten to take into account more fully the psychological roots of the necessity of order and the search for justice, the conceptual scope and material components of the concept of justice, as well as the criteria for the validity of law. The third part of Bodenheimer`s study deals with the problems of the legal method and modes of legal argumentation. When Edgar Bodenheimer`s book Jurisprudence: The Philosophy and Method of the Law was published in 1962, it received extraordinary reviews. It has been described by one commentator as a « profoundly scientific, clearly written and unpretentious contribution to the literature of jurisprudence ». Because there have been significant developments in analytical jurisprudence and in the legal philosophy of values, Bodenheimer updated his book. Harvard University Press has partnered with De Gruyter to offer virtually all copyrighted HUP books that have not been available for sale worldwide since their original publication. The 2,800 titles of the « e-ditions » program can be purchased individually as PDF e-books or print-on-demand editions via the « Available at De Gruyter » link above. They are also made available to the institutions in ten separate thematic packages that reflect the entire spectrum of the press catalogue.
